Labour Market Impact Assessment (LMIA)

LMIA to support Permanent Residency

Employers interested in hiring skilled foreign workers, who may already be in Canada or located overseas, can support their application for permanent residency. For foreign nationals to be eligible for this specific LMIA stream, they must qualify for one of the following economic programs under the Express Entry system:

  • Federal Skilled Worker Program (FSWP)
  • Federal Skilled Trades Program (FSTP)
    Note: Under the FSTP, the employment offer can be made by up to 2 employers
  • Canadian Experience Class (CEC)

    The foreign worker is awarded 50-200 CRS points (based on NOC code) for LMIA based job offer.

LMIA to support permanent residency application

This LMIA is used to support permanent residency application of foreign national. Here employer hires the skilled foreign national only after their immigration application is processed and permanent residency is approved. This option does not have a processing fee.

LMIA to support both permanent residency & work permit application “ dual intent LMIA

Employers can support both work permit and permanent residency applications together. This approach is known as a “dual intent LMIA.” Here, the foreign national applies for both a work permit and permanent residency simultaneously. Typically, work permit applications are processed faster than permanent residency applications, allowing the foreign national to begin employment with the Canadian employer while their permanent residency is being processed.

Important Points

  • The employer is not required to submit a transition plan under this stream.
  • LMIA can be applied under both (high -wage & low-wage) streams. 
  • The job offer must be for at least one year of full-time (minimum 30 hours per week) work under TEER 0/1/2/3 of NOC. 

 

Following employers are not eligible to make a job offer under this program:

  • An embassy.
  • A high commission or consulate in Canada.
  • Ineligible employers listed by IRCC. 
  • If you are a new employer and have not been in business for at least one year.
  • If you are hiring workers who intend to reside in Quebec.
