How to sponsor your parents or grandparents through Super Visa

If you want to bring your parents and grandparents to Canada, you can apply for a Super Visa Application. Super Visa allows the parents and grandparents of Canadians and permanent residents to stay in Canada for up to 2 years without the need to renew their status. It also provides multiple entries for a period of up to 10 years.

Eligibility Requirements for Super Visa

  • Parents and grandparents of a Canadian citizen or permanent resident of Canada.
  • Applicant (parent or grandparent) require a financial assistance letter from their child or grandchild in Canada that fulfills the minimum gross income as per LICO.
  • The applicants must have a signed Invitation Letter from the child or grandchild who invites them to Canada that including the list and number of people in the household of the sponsor.
  • The applicant must have proof of a Canadian medical insurance covering a minimum of $100,000 for at least one year and meeting minimum requirements, including coverage for health care, hospitalization, and repatriation.
  • Applicants must be eligible for a temporary resident visa and should not be ineligible on criminal and/or medical grounds.
  • Document confirming that the applicant had an immigration medical exam

The following documents are examples of what can be used as proof of funds while applying for Super Visa

  • The most recent tax year’s Notice of Assessment (NOA) or T4/T1
  • Letter of employment that includes salary terms and hiring date
  • Bank statements
  • Pay stubs

In addition, immigration officers will also consider whether the applicant (parent or grandparent) will actually leave the country at the end of the authorized stay. It is important to take note that no dependents can be included in the application for super visa.

Benefits of super visa for applicants from TRV and TRV-exempt countries

The super visa is also ideal for parents and grandparents living in countries that require a Temporary Residence Visa (TRV) for entry into Canada. With the Super Visa, people can travel without having the need for routinely re-applying for a TRV between Canada and their country of residency.

Super Visa is also beneficial to applicants from TRV-exempt nations. The same application process can be used. Instead, issuing a visa, they will be handed a formal letter from IRCC authorizing travels to Canada for a period of up to two years.

How to sponsor your spouse to Canada

Family reunification is of utmost importance to the Canadian government. IRCC offers various pathways to sponsor your loved ones for immigration to Canada. If you are a Canadian Citizen or Permanent resident, you can apply for a Spousal Sponsorship application. If you are an international student or temporary foreign worker, you can opt for Spousal open work permit application.

Under Canadian Immigration Levels Plan 2021-2023, IRCC aims to roll mats for over 80,000 new immigrants per year through its Spousal, Partner, and Children category. Most of these immigrants will arrive as the spouses or partners of Canadian citizens and permanent residents.

Spouses or common-law partners of Canadian citizen or permanent resident

If you are a Canadian citizen or permanent resident of Canada, you may sponsor your spouse to become permanent residents of Canada with Spousal sponsorship Application. As a Canadian PR your spouse, common law or conjugal can live, study and work in Canada. When your partner comes to Canada as a permanent resident, you are responsible for financially supporting them when they arrive.

Eligibility Requirements to be a sponsor:

  • Must Be at least 18 years of age.
  • Must be a Canadian permanent resident living in Canada or a Canadian citizen.
  • You and your spouse, common law or conjugal partner must sign a sponsorship agreement that commits you to provide financial support to your family member, if necessary.
  • You must provide financial support to a spouse for three years from the date you become a permanent resident.
  • You must provide financial support to your dependent child(ren) for 10 years, or until they turn 25, whichever comes first.

Eligibility Requirements to be sponsored:

  • Be at least 18 years old
  • Be legally married or in common law relationship (living together at least 12 consecutive months)

Spouses or common-law partners of full-time students [C42]

If you are an international student studying full-time with a valid student permit, you can apply for Spousal open work permit application. This permit will allow your partner to work full time while you are studying in Canada. In general, this “open work permit” will have the same duration as the Study Permit issued to the sponsor. If you have a dependent child, you can apply for a temporary resident visa (study /visitor) for your child. This will allow you to unite with your child.

Eligibility Requirements to be a sponsor:

  • Must Be at least 18 years of age.
  • Must be a must be a full-time student
  • Public post-secondary school, such as a college or university, or CEGEP in Quebec.
  • Private university level school in Quebec
  • Canadian private school that can legally grant bachelor’s, master’s, or doctoral degrees.

Spouses or common-law partners of skilled workers [C41]

Spouses or common-law partners of skilled workers coming to Canada may apply for a Spousal open work permit without having an offer of employment. A dependent spouse or common-law partner is eligible to apply for an open work permit under Labour Market Impact Assessment (LMIA) exemption code C41 if the principal foreign worker.

Eligibility Requirements to be a sponsor:

  • Must Be at least 18 years of age, and physically resides or plans to physically reside in Canada while working.
  • Must hold a work permit that is valid for a period of at least 6 months.
  • Must be employed in an occupation that falls within National Occupational Classification (NOC) skill type 0, A or B.

Skilled Immigration: A necessity for Canada to fill vacant jobs

As the world strives to put Covid-19 in its rearview mirror, however difficult it might be. The post-COVID era for Canada looks bleak, especially in the labor market. There are already 550,000 unfulfilled skilled jobs, and reports are suggesting that this number will only rise as 125,000 more workers are expected to quit or retire by the end of this year.

It doesn’t sound as promising especially for a developed country like Canada, but it presents itself as a silver lining for skilled people around the globe who are planning to migrate from their home country. Canada is in a dire need for skilled people and is planning to fill those positions by inviting immigrants. Just in the month of July 2021 Canada welcomes 40,000 immigrants, 4000 more than the previous month and the number will only go up as the Canadian Economy tries to recover from the hit it took during the past year.

There are multiple ways for skilled workers to immigrate to Canada.

Express Entry

Express Entry is a points-based system that manages immigration applications for the three Federal High Skilled programs, which include the: Canadian Experience Class, Federal Skilled Worker Program, and Federal Skilled Trades Program. IRCC regularly invites skilled workers from both inside and outside Canada through this program.

The Canadian Experience Class (CEC) is for skilled workers who have Canadian work experience and want to become permanent residents. Having obtained work experience in Canada, these individuals have already settled into Canadian society and established important networks in their communities and their careers.

Federal Skilled Worker (FSW) applications are assessed based on an applicant’s ability to become economically established upon immigration to Canada. This is Canada’s flagship immigration program for workers, allowing the country to welcome tens of thousands of newcomers every year. This is a key category of the Express Entry (EE) program.

The Federal Skilled Trades Program (FSTP) is for skilled workers who want to become permanent residents based on being qualified in a skilled trade. This economic immigration program was developed at the request of Canadian businesses and employers who were struggling to find enough skilled trade workers to help them complete their work on time.

Provincial Nominee Programs

The British Columbia Provincial Nominee Program (BC PNP) regularly invites a number of skilled workers to apply for provincial nomination for permanent residence. This is through the Skilled Worker and International Graduate category.

The BC PNP also offers a priority pathway to certain tech workers called the BC Tech stream. This Provincial Nominee Program (PNP) targets candidates who have job offers in one of 29 eligible tech occupations.

Ontario Immigrant Nominee Program targets prospective immigrants with the desired skills and experience for immigration nomination. The In-Demand Skills Stream in Ontario provides some workers in high-need occupations a pathway to permanent residence.

The Atlantic Immigration Pilot is yet another option for skilled workers who wish to make their new home in any one of Canada’s Atlantic provinces – New Brunswick, Newfoundland and Labrador, Nova Scotia and Prince Edward Island.

Work Permits

Skilled workers can temporarily come to Canada under one of two paths, Temporary Foreign Worker Program (TFWP) and International Mobility Program. This stream allows foreign workers to work in Canada for Canadian companies.

8687 LMIA’s were approved in the first quarter of 2021, despite the adverse effects of COVID-19. This demonstrates shortage of skilled workers in Canada, which has now become a perennial problem with plummeting interest from new generations to enter trades and more veteran tradespeople retiring.

It can be predicted that job vacancy rates will continue to rise in the short term, particularly in service-oriented jobs. This gap in the labor market has created a golden opportunity for foreign skilled workers to apply for jobs in Canadian companies facing labor shortage.

To attract immigrants, Canada is introducing new policies that help protect foreign domestic workers from a drop in wages. Canada is also investing in settlement services for temporary foreign workers who are eligible to transition to permanent residence.

How to apply for TR to PR open work permit

On April 14, 2021, a new program was announced to aid the temporary residents in obtaining Canada’s Permanent Residency. Immigration, Refugees and Citizenship Canada (IRCC) named this program as TR to PR pathway program and began accepting applications under this program from May 6, 2021.

As per IRCC (Immigration, Refugees and Citizenship Canada), the applicants of TR to PR pathway program are now allowed to apply for an Open Work Permit. The open work permits issued under this program will be valid till December 2022.

This decision was made by the government to oblige those who continued to work during COVID-19 crisis. IRCC was also aware of the fact that renewal of temporary resident status would have been challenging for the applicants with LMIA based work permits.

Therefore, certain regulations will be waived as part of this policy to speed up the issue of open work permits. It will act as a bridging work permit for the applicants, while they await results for their PR applications under TR to PR pathway program.

Eligible applicants may apply online or through paper-based applications. An applicant cannot apply for a work permit at port of entry.

Eligibility Requirements

To be eligible under this policy, applicant must:

  • Have applied permanent residency application under one of the TR To PR policies (Workers in essential occupations (health and non-health), French-speaking workers in essential occupations (health and non-health), Recent international graduates from a Canadian post-secondary institution, French speaking international graduates from a Canadian institution).
  • Be legally authorized to work with a valid work permit, or an authorization to work without work permit.
  • Be residing in Canada at the time of Open Work Permit Application.
  • Have met language requirements for TR To PR pathway while applying permanent residency application.
  • Be lawfully eligible to maintain or restore their status as workers in Canada.
  • Be employed at the time of applying permanent residency application.
  • Apply up to 4 months before current work permit expires.

Please note that the eligible family members (Common-law partner/Spouse/Dependent child over the age of 18 years) of the TR to PR applicants can also apply for an open work permit any time under this program.

The TR to PR program will expire on November 5, 2021, or when the maximum number of applications have been received. So far, the two categories which have reached their maximum capacities are international graduates and essential workers.

Candidates can still apply in the following quotas according to their eligibility:

  • French-speaking International Graduates (no cap)
  • French-speaking Health Care Workers (no cap)
  • French-speaking Essential non-health workers (no cap)
